Should You Accept Partial Rent Payments?
A tenant offers half the rent now and the rest next week. Taking it seems like a no-brainer, but in some situations it can reset or waive your legal options. Here's how to handle it.
The short answer
Accepting partial rent is usually fine and often smart, before you've started any formal process. Once you've served a notice to pay or quit, or filed for eviction, accepting partial payment can waive the notice or the case in many states. Then the rules get state-specific fast.
Are you required to accept partial rent?
In most states, no. Your lease entitles you to full rent on the due date, and you can refuse a partial payment. There are exceptions: some states and cities restrict refusing partial payments in certain situations, and some rental assistance programs come with conditions. Check your state's rules.
When accepting partial rent makes sense
- The tenant has a good history and a believable short-term problem
- They've told you up front and proposed a specific date for the rest
- You haven't served any formal notice yet
When to be careful
- After serving a notice: accepting money can be treated as waiving the notice. Some states let you accept partial rent and still proceed only if you give written notice that you're doing so. Others don't allow it at all.
- During an eviction case: accepting rent may require dismissing and refiling.
- Repeated partial payments: if it becomes a pattern, you're effectively running an unwritten payment plan. Make it written.
How to document a partial payment
- 1Give a receipt showing the amount, the period, and the remaining balance.
- 2Record it in your rent ledger.
- 3Confirm in writing when the balance is due, ideally in a short payment plan both of you sign.
- 4If you've already served notice, check your state's rules before cashing anything.
Hi Taylor, thanks for your payment of $700 today toward November's rent of $1,400. The remaining balance of $700 is due by November 15. Accepting this partial payment doesn't change the other terms of your lease. Let me know if anything changes.
Frequently asked questions
Does accepting partial rent stop an eviction?+
In many states it can, especially if you accept it after serving a notice or filing a case without the right written reservation. Rules vary widely, so get local advice before accepting money once the process has started.
Can I charge a late fee on the unpaid balance?+
If your lease allows a late fee and the remaining balance is paid after the grace period, a fee typically still applies, subject to your state's limits. Be consistent and put it in writing.
